Preliminary Information Form

This form has been prepared under Consumer Protection Law No. 6502 and the Distance Contracts Regulation to inform the BUYER before a contract is concluded for orders placed via aydinticaret.com.tr. It is presented to the BUYER together with the order summary before the order is confirmed and is approved by the BUYER electronically.

Products subject to the contract

The essential characteristics of the products (brand, model, product code, pack size, colour, etc.) are shown on the product pages and in the order summary. The product, quantity and price information shown in the order summary forms an integral part of this form.

Price and payment

  • The total price of the products including all taxes, and any shipping and delivery costs, are shown in the order summary before the order is confirmed.
  • Payment can be made by credit card, debit card or bank transfer. Instalment options depend on the conditions of the card-issuing bank.
  • Card details are processed by a licensed payment institution; they are neither seen nor stored by the SELLER.
  • Orders paid by bank transfer are prepared once the payment reaches the SELLER’s account.

Delivery

Products are shipped with a contracted cargo company to the address given by the BUYER when ordering. The delivery time is stated on the product page or in the order summary and in any case may not exceed thirty days from the date the order reaches the SELLER. The BUYER may terminate the contract for orders not delivered within this period.

Right of withdrawal

The BUYER has the right to withdraw from the contract within fourteen days from the day the goods are delivered to the BUYER or to a third party designated by the BUYER, without giving any reason and without paying any penalty. For orders whose goods are delivered separately, the period starts on the day the last item is received.

To exercise the right of withdrawal it is sufficient to notify the SELLER within this period by a clear statement, in writing or via a durable medium. Notice can be given through the following channels:

The BUYER returns the goods to the SELLER within ten days of sending the withdrawal notice. For returns made with the cargo company specified by the SELLER, the return cost is borne by the SELLER. The SELLER refunds all payments, including delivery costs, within fourteen days of receiving the withdrawal notice, using the payment method used by the BUYER and free of charge.

The BUYER is liable for changes and deterioration resulting from use of the goods beyond their ordinary use during the withdrawal period.

Exceptions to the right of withdrawal

Under Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for the following goods:

  • Goods prepared according to the BUYER’s requests or personal needs (for example paint mixed to a colour code supplied by the BUYER, or products cut to size).
  • Goods that deteriorate quickly or may pass their expiry date.
  • Goods whose protective elements such as packaging, tape, seal or wrapping have been opened after delivery and which cannot be returned for health or hygiene reasons; chemical products whose lids have been opened (paint, varnish, hardener, thinner, filler, adhesive, etc.).
  • Goods which, after delivery, are by their nature inseparably mixed with other items.
  • Goods whose price depends on fluctuations in the financial markets beyond the SELLER’s control.

Defective goods

If the goods delivered are defective, the BUYER may, under Article 11 of Law No. 6502, choose to withdraw from the contract, obtain a price reduction proportional to the defect, have the goods repaired free of charge or exchange them for non-defective equivalents.

Complaints and objections

The BUYER may send complaints to the SELLER through the contact channels above. In case of dispute, the BUYER may apply to the consumer arbitration committee at the BUYER’s place of residence or where the transaction was made, within the monetary limits announced each year by the Ministry of Trade, and to the consumer court for disputes exceeding those limits.

Business buyers

Purchases made for commercial or professional purposes as a merchant are outside the scope of Law No. 6502; the right of withdrawal does not apply to them, and the Turkish Commercial Code, the Turkish Code of Obligations and any quotation and order terms agreed between the parties apply.

Record

This form and the Distance Sales Agreement are sent to the email address provided by the BUYER after order confirmation and are kept by the SELLER for the period required by law.
